1. General provisions

  1. These terms and conditions (“Terms”) set out the rules for using the website available at eshield.pl (the “Service”).
  2. The operator of the Service is Engineering Shield Spółka z ograniczoną odpowiedzialnością with its registered office in Łódź, ul. Milionowa 4b (City Space), 93-102 Łódź, entered in the register of entrepreneurs of the National Court Register (KRS) under number 0001109317, NIP 7282886000, REGON 528814811 (the “Operator”).
  3. The Service is informational and business-oriented (B2B) and is intended exclusively for:
    a) entrepreneurs,
    b) persons acting in the name of or on behalf of entrepreneurs,
    c) other professional entities.
  4. The Service is not intended for consumers within the meaning of the Civil Code, and the Operator does not address offers to consumers through it.
  5. Use of the Service constitutes acceptance of the Terms.

2. Nature of information in the Service

  1. The Service is used in particular to present the Operator’s business, including services in the field of:
    a) industrial automation,
    b) design and construction of machinery and production lines,
    c) machinery safety audits, risk assessment and adaptation measures,
    d) certification/conformity assessment (including CE) and documentation,
    e) engineering outsourcing,
    f) specialist training,
    g) publication of expert content in the area of engineering and regulatory compliance.
  2. Information posted in the Service, including descriptions of services, case studies, articles and educational content:
    a) is of a general and informational nature,
    b) does not constitute an offer within the meaning of the Civil Code,
    c) does not constitute an assurance of results or a guarantee of achieving specific outcomes,
    d) does not constitute legal or engineering advice for a specific case.
  3. Entering into an agreement for the Operator’s services takes place each time on the basis of separate arrangements, in particular an offer, order, framework agreement or project agreement.

3. Rules for using the Service

  1. The User is obliged to use the Service in accordance with the law, good practice and the Terms.
  2. It is prohibited to undertake actions that could:
    a) disrupt the operation of the Service or the Operator’s infrastructure,
    b) compromise the security of the Service, including attempts at unauthorized access (e.g. scanning, exploitation, bypassing security measures),
    c) infringe the rights of third parties or the Operator, including copyrights and industrial property rights,
    d) lead to the distribution of spam or abuse of contact forms.
  3. The Operator may temporarily restrict access to the Service in connection with maintenance work, updates or technical reasons.

4. Contact, inquiry form and communication

  1. The Service enables contact with the Operator via:
    a) a contact form,
    b) e-mail,
    c) telephone.
  2. Submitting an inquiry or message does not constitute entering into an agreement and does not impose an obligation on the Operator to present an offer.
  3. As a rule, the Operator’s responses to inquiries are informational or preliminary and become binding only after confirmation in a form agreed by the parties (e.g. offer, order, agreement).
  4. The Operator may use security mechanisms to protect forms and communication against abuse (e.g. anti-spam solutions).

5. Consent-dependent functionalities and technical safeguards

  1. The Service uses a consent management mechanism (banner/consent panel) regarding cookies and the activation of selected external services.
  2. Consent may be required to enable certain additional functionalities, in particular:
    a) visit statistics (Google Analytics),
    b) maps (Google Maps).
  3. Lack of consent to statistical cookies or additional functionalities does not restrict access to the Service content, but may result in certain additional elements not functioning (e.g. maps).
  4. The Operator applies technical measures to increase the security of the Service, including a content security policy (CSP), which limits the ability to load external resources to the necessary minimum.

6. Copyright and intellectual property

  1. Content made available in the Service, in particular texts, graphics, logotypes, video materials, the website layout and visual identification elements, constitutes the Operator’s property or is used under a license.
  2. It is prohibited to copy, distribute, modify or use the content of the Service in whole or in part without the Operator’s prior consent, except for permitted use resulting from legal provisions.

7. Operator’s liability

  1. The Operator exercises due care to ensure that the Service operates properly and that published content is reliable and up to date, but does not guarantee uninterrupted availability of the Service.
  2. The Operator shall not be liable for:
    a) interruptions in the availability of the Service resulting from technical reasons or reasons beyond the Operator’s control,
    b) consequences of using the Service content without analyzing a specific case or without entering into an agreement,
    c) actions of third parties, including providers of telecommunications or hosting services, over which the Operator has no control.
  3. To the extent permitted by law, the Operator’s liability towards users who are entrepreneurs is limited to actual damage, excluding lost profits.

8. Personal data and cookies

  1. The rules for the processing of personal data are set out in the Privacy Policy available on the Website.
  2. The rules for the use of cookies are set out in the Cookie Policy available on the Website.

9. Links to external websites

  1. The Website may contain links to third-party websites.
  2. The Operator is not responsible for the content, privacy policies, or practices of those entities.

10. Amendments to the Terms and Conditions

  1. The Operator may amend the Terms and Conditions in the event of:
    a) changes to the functionality of the Website,
    b) changes in the technologies used,
    c) changes in legal regulations,
    d) organizational changes of the Operator.
  2. The current version of the Terms and Conditions is published on the Website and is effective as of the date of its posting.

11. Governing law and jurisdiction

  1. The Terms and Conditions are governed by Polish law.
  2. Any disputes arising from the use of the Website will be resolved by the court having jurisdiction over the Operator’s registered office, unless mandatory provisions of law provide otherwise.
